Intellectual Property Policy

Perfect Haze (“Company”) continually invests significant resources to create software, text, and other materials. The majority of these materials are protected under copyright laws of the United States and of other countries worldwide. To protect its investment, Company diligently guards against infringement of its copyrighted materials. This policy outlines certain conduct that violates Company’s copyrights. This policy is subject to change at any time and without notice.


Copyright

Copyright protects original works of authorship fixed in a tangible medium of expression. Copyright infringement occurs when any one or more of the following rights is violated: (1) reproduction; (2) adaptation; (3) distribution to the public; (4) performance in public; or (5) display in public. Copyright infringement issues can also arise when a new work or a modification of an existing work, known as a derivative work, is created from a copyrighted work. A derivative work is based upon a pre-existing work in which the pre-existing work is changed, condensed, recast, transformed, adapted, or embellished. If the pre-existing or underlying work is a protected work under copyright law, one who wishes to exploit the derivative work must obtain a license from the owner of the copyright in the underlying work or works. Thus, modification of Company’s copyrighted materials without explicit permission for commercial use constitutes infringement. Without written permission from Company, you may not make any unauthorized reproduction or engage in distribution of Company’s copyrighted materials, which include, but are not limited to, materials such as books, publications, computer software (including object code and source code), online curricula, web content, diagrams, photos, testing materials, exams, text, images, and graphics published by Company in any format. It is Company policy to enforce its copyrights against any third party who infringes on its copyright. To ensure that you do not infringe on any of Company’s copyrighted materials:

  1. Do not directly or indirectly copy, reproduce or distribute any of Company’s materials (including Web pages) or any part of the text or graphics from those materials;

  1. Do not directly or indirectly modify or create derivative works of any of Company’s materials;

  1. Do not copy, reproduce or modify source code or object code of any of Company’s products;

  1. Do not create an emulator or simulator of a Company product in a manner that is likely to confuse the public about the source of the emulator or simulator;

  1. Do not create materials that look as though they originated from or are endorsed by Company;

  1. Do not imitate the color or visual appearance of Company’s materials and/or products;

  1. Do not use Company’s icons as graphical design elements in your materials; and

  1. Do not distribute Company’s work by sale, rental, or other disposition.

COPYRIGHT INFRINGEMENT CLAIMS

It is Company’s policy to (1) block access to or remove material that it believes in good faith may be the intellectual property of a third party (e.g., copyrights, trademarks, trade secrets, etc.) that has been illegally copied and distributed by any of our vendors, distributors, advertisers, affiliates, content providers, members or users; and (2) remove and discontinue service to and relationship with Repeat Infringers. A “Repeat Infringer” is considered any person or entity for whom Perfect Haze has received more than three notices of claimed infringement or for which Perfect Haze has had to remove content more than three times. Notwithstanding the definition provided above, Perfect Haze reserves the right to immediately terminate service to and/or relationship with any person for egregious infringing activities in Perfect Haze’s sole determination and discretion.

If you believe that material or content residing on or accessible through this website or service infringes an intellectual property right that you own or control, please send a notice by mail only (and not by email) of claimed infringement containing the following information and only the following information to the DMCA Agent listed below.


Your communication must include all of the following:

  1. Identification of the copyrighted work claimed to have been infringed;

  2. Identification of the material that is claimed to be infringing and information reasonably sufficient to permit the service provider to locate the materials;

  3. Information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.

  4. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner;

  5. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of the copyright that is allegedly infringed;

  6. A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright that is allegedly infringed.

 

We reserve the right to ignore a notice that is not in compliance with the DMCA, and we may, but are not obligated to, respond to a non–compliant notice. Do not send any information, attachments or enclosures that are not specifically requested in the list above.

Please note that Perfect Haze is required to take reasonable steps to notify any person or entity that posted or helped post the allegedly infringing content (“Alleged Infringer”). A copy of the legal notice will be forwarded to the Alleged Infringer, who will be allowed to send Perfect Haze a counter-notification as required by law.

Upon receipt and determination that a proper bona fide infringement notification has been made, Perfect Haze will: (a) remove or disable access to the alleged infringing material; (b) notify the content provider, member, user or other person relating to the alleged infringing material that it has removed or disabled access to the material; and (c) terminate service to and/or relationship with such person(s) as a repeat infringer, if so determined.
